1 De procedure

1.1.

Het verloop van de procedure blijkt uit:

-

de dagvaarding van 1 mei 2017, met producties 1 tot en met 27;

-

de conclusie van antwoord van 2 mei 2017, met producties 54 tot en met 63 en C1 tot en met 53 (afkomstig uit de hierna te noemen VRO-procedure);

-

de e-mail van 2 mei 2017 van mr. De Lange, waarin hij onder meer melding maakt van de tussen partijen gemaakte proceskostenafspraak;

-

de mondelinge behandeling gehouden op 3 mei 2017;

-

de pleitnota van Biogen c.s.;

-

de door Biogen c.s. ter zitting overgelegde Patent License Agreement;

-

de pleitnota van Celltrion c.s. met uitzondering van de niet-voorgedragen paragrafen 64 (deels), 65, 66 en 76 tot en met 83;

-

het proces-verbaal van de mondelinge behandeling, waarin de tussen Biogen c.s. en Mundipharma getroffen voorlopige regeling met betrekking tot de periode tot aan de vonnisdatum is vastgelegd.

1.2.

Vonnis is bepaald op heden.

2 De feiten

2.1.

Biogen is een innovatief Amerikaans biofarmaceutisch bedrijf. Zij ontwikkelt onder meer medicijnen op het gebied van hematologie en auto-immuunziekten. Zij brengt onder meer een geneesmiddel op de markt voor de behandeling patiënten met chronische lymfatische leukemie (hierna: CLL) dat een anti-CD20 monoklonaal antilichaam bevat dat bekend staat onder de naam Rituximab. In Nederland wordt Rituximab door Roche –licentienemer van Biogen – op de markt gebracht onder de naam MabThera. MabThera is ook goedgekeurd voor het gebruik bij de behandeling van verschillende andere ziekten, waaronder non-Hodgkin lymfoom en reumatoïde artritis.

2.2.

Biogen is houdster van het Europese octrooi EP 2 055 313 (hierna: EP 313 of het octrooi) met de titel “Treatment of hematologic malignancies associated with circulating tumor cells using chimeric anti-CD20 antibody”. Het octrooi is verleend op 29 april 2015 op basis van een (van de aanvrage voor EP 616 572 (hierna: EP 572)) afgesplitste aanvrage onder inroeping van prioriteit van 9 november 1998 op basis van US 107658.

Het octrooi heeft onder meer gelding in Nederland. Het octrooi heeft 16 conclusies. Deze luiden in de oorspronkelijke Engelse taal als volgt:

  1. Use of an anti-CD20 antibody comprising human gamma 1 constant regions in the manufacture of a medicament for treatment of chronic lymphocytic leukemia (CLL) in a human patient, wherein the medicament is for administration to the human patient at a dosage of 500 to 1500 mg/m2.

  2. Use according to claim 1, wherein the medicament is for use in combination with chemotherapy.

  3. Use according to claim 1 or claim 2, wherein the anti-CD20 antibody is a chimeric antibody.

  4. Use according to claim 1 or claim 2, wherein the anti-CD20 antibody is a humanized antibody.

  5. Use according to claim 1 or claim 2, wherein the anti-CD20 antibody is a human antibody.

  6. Use according to claim 1 or claim 2, wherein the anti-CD20 antibody comprises a CD20-binding antibody fragment.

  7. Use according to claim 3, wherein the anti-CD20 antibody is rituximab.

  8. Use according to any one of claims 1-7, wherein the patient is refractory to a treatment previously administered for the chronic lymphocytic leukemia.

  9. An anti-CD20 antibody comprising human gamma 1 constant regions for use in a method for treatment of chronic lymphocytic leukemia (CLL) in a human patient, the method comprising administering the antibody to the human patient at a dosage of 500 to 1500 mg/m2.

  10. The antibody for use according to claim 9, wherein the method comprises administering the antibody in combination with chemotherapy.

  11. The antibody for use according to claim 9 or claim 10, wherein the anti-CD20 antibody is a chimeric antibody.

  12. The antibody for use according to claim 9 or claim 10, wherein the anti-CD20 antibody is a humanized antibody.

  13. The antibody for use according to claim 9 or claim 10, wherein the anti-CD20 antibody is a human antibody.

  14. The antibody for use according to claim 9 or claim 10, wherein the anti-CD20 antibody comprises a CD20-binding antibody fragment.

  15. The antibody for use according to claim 11, wherein the anti-CD20 antibody is rituximab.

  16. The antibody for use according to any one of claims 10 to 15, wherein the patient is refractory to a treatment previously administered for the chronic lymphocytic leukemia.

In de onbestreden Nederlandse vertaling luiden deze conclusies als volgt:

  1. Toepassing van een anti-CD20-antilichaam, omvattende menselijke gamma 1 constante regio's bij de bereiding van een geneesmiddel voor behandeling van chronische lymfocytische leukemie (CLL) bij een menselijke patiënt, waarbij het geneesmiddel dient voor toediening aan de menselijke patiënt in een dosering van 500 tot 1500 mg/m2.

  2. Toepassing volgens conclusie 1, waarbij het geneesmiddel dient voor toepassing in combinatie met chemotherapie.

3. Toepassing volgens conclusie 1 of 2, waarbij het anti-CD20-antilichaam een chimeer antilichaam is.

4. Toepassing volgens conclusie 1 of 2, waarbij het anti-CD20-antilichaam een gehumaniseerd antilichaam is.

5. Toepassing volgens conclusie 1 of 2, waarbij het anti-CD20-antilichaam een menselijk antilichaam is.

8. Toepassing volgens een van de conclusies 1-7, waarbij de patiënt ongevoelig is voor een behandeling die eerder voor de chronische lymfocytische leukemie is toegediend.

9. Anti-CD20-antilichaam, omvattende menselijke gamma 1 constante regio's, voor

toepassing bij een werkwijze voor behandeling van chronische lymfocytische leukemie (CLL) bij een menselijke patiënt, waarbij de werkwijze toediening van het antilichaam aan de menselijke patiënt in een dosering van 500 tot 1500 mg/m2 omvat.

10. Antilichaam voor toepassing volgens conclusie 9, waarbij de werkwijze toediening van het antilichaam in combinatie met chemotherapie omvat.

11. Antilichaam voor toepassing volgens conclusie 9 of 10, waarbij het anti-CD20-antilichaam een chimeer antilichaam is.

12. Antilichaam voor toepassing volgens conclusie 9 of 10, waarbij het anti-CD20-

antilichaam een gehumaniseerd antilichaam is.

13. Antilichaam voor toepassing volgens conclusie 9 of 10, waarbij het anti-CD20-

antilichaam een menselijk antilichaam is.

14. Antilichaam voor toepassing volgens conclusie 9 of 10, waarbij het anti-CD20-antilichaam een CD20-bindend antilichaamfragment omvat.

15. Antilichaam voor toepassing volgens conclusie 11, waarbij het anti-CD20-antilichaam rituximab is.

16. Antilichaam voor toepassing volgens een van de conclusies 10-15, waarbij de patiënt ongevoelig is voor een behandeling die eerder voor de chronische lymfocytische leukemie is toegediend.

In deze procedure beroept Biogen c.s. zich uitsluitend op conclusie 7 en conclusie 15 van EP 313. Het betreft een tweede medische indicatie octrooi. Conclusie 7 is in Swiss type-vorm en conclusie 15 is in EPC 2000-vorm. Tegen EP 313 is oppositie ingesteld.

2.3.

In de aanvrage (WO00/27428) die heeft geleid tot EP 313 is onder meer een voorbeeld (Example 3) opgenomen dat afkomstig is uit de (grootmoeder)aanvrage die hoort bij het prioriteitsdocument US 107658. In de aanvrage WO00/27428 is – voor zover hier van belang – het volgende opgenomen:

Effective dosages will depend on the specific antibody, condition of the patient, age, weight, or any other treatments, among other factors. Typically effective dosages will range from about 0.001 to about 30 mg/kg body weight, more preferably from about 0.01 to 25 mg/kg body weight, and most preferably from about 0.1 to about 20 mg/kg body weight.

Such administration may be effected by various protocols, e.g., weekly, bi-weekly, or monthly, dependent on the dosage administered and patient response. Also, it may be desirable to combine such administration with other treatments, e.g., radioactive therapy, both targeted and non-targeted, chemotherapies, and lymphokine or cytokine administration, e.g., interleukins, interferons, TNF’s, colony stimulating factors, etc.

Typically, treatment will be effected weekly, for about 2 to 10 weeks, more typically about 4 weeks. A particularly preferred dosage regimen will comprise administration of about .375 mg/kg weekly for a total of four infusions. Also, stepped-up dosing schedules may be even more preferable.

The following Examples are not intended, nor are they to be construed, as limiting the invention. The Examples are intended to provide clinical evidence in support of the efficacy of the invention.

Example 3

Phase I/II Study of Rituxan in CLL®

RITUXAN® is a monoclonal antibody targeting CD20 that has significant activity in the treatment of low-grade lymphoma (LGL). When given at a dosage of 375 mg/m3 weekly/four response rate in relapsed patients (PTS) was 43% (McClaughlin et al, KOO, Vol. 14, 1998). Patients with small lymphocytic lymphoma had lower response rates (13%) than patients with other subtypes of LGL and lower serum levels of RITUXAN®. Reduced response seen in SLL could be related to lower density of CD20 antigen and/or higher circulating B-cell counts. Both factors would be expected to impact (negatively) on response seen in CLL. In an attempt to maximize activities in CLL we are conducting a Phase I/II study. All patients receive a first dose of 375 mg/m3 to minimize infusion-relapsed side effects.

Subsequent weekly dosages (3) remain the same but are given at an increased dose level. Sixteen patients have been treated at dosages of 500-1500 mg/m3. Medium age was 66 years (range, 25-78). Eighty-one percent had end-stage III-IV disease. Medium white blood cell count was 40 x 10°/L (range, 4-200), Hgb 11.6 g/dl (range, 7.7-14.7), platelets 75 x 109/L (range, 16-160), median β2 immunoglobulin was 4.5 mg/L (range, 3.1-9.2). Median numbers of prior therapies was 2.5 (range 1-9). Sixty percent of patients were refractory to treatment. Two patients developed severe hypertension with the first dose

(375 mgm3); another one received further therapy. Toxicity at subsequent escalated dosages has been mild although no patient at the 1500 mg/m3 dose level has been fully evaluated. Eight patients have completed therapy (4 at 500 mg/m3, 3 at 650 mg/m3, 1 at 825 mg/m3). One patient treated at 560 mg/m3 achieved full remission. One patient has progressive lymphocytosis on treatment and all other patients had reduction in peripheral blood lymphocytosis but less effect on lymph nodes. Dose escalation studies are ongoing.

2.4.

Conclusie 1 van EP 572 (de aanvrage waarvan EP 313 een afsplitsing is) luidde als volgt:

Use of rituximab in the manufacture of a medicament for treatment of chronic lymphocytic leukemia (CLL) in a human patient, wherein the medicament is for administration to the human patient at a first dose of 375 mg/m2 and subsequent dosage of 500 to 1500 mg/m2.

Tegen EP 572 is oppositie ingesteld. In juli 2013 heeft de OD1 EP 572 herroepen in verband met toegevoegde materie. In de gronden voor de beslissing heeft de OD onder verwijzing naar het hiervoor in 2.3 aangehaalde Example 3 in 3.10.3.5 en voorts 3.10.3.6 tot en met 3.10.3.11 en 5.13 het volgende overwogen:

3.10.3.5 It remains to be determined whether the individual components of the dosage regimen i.e. the number of doses, their timing and their relative height can be separated from each other without infringing Art. 123(2) EPC. P argued that the invention related to a stepped-up dosing schedule as disclosed at p. 6, l. 24 and p. 8, l.19-20 which was sufficiently defined by a first dose and a subsequent higher dose. Thus, the first dose of 350 mg/m2 as reported in Example 3 could be extracted together with the dose level of 500-1500 mg/m2 for a subsequent stepped-up dose from other features of the dosage regimen of Example 3. The OD does not agree with this view. Firstly, the term "stepped-up dosing schedule" as opposed to the term "stepped-up dose or dosing" comprises the word schedule which introduces the notion of a timing of the doses. Secondly, D3 explicitly states at p. 6, l. 15 that administration protocols i.e. the timing between doses depends 'on the dosage administered and patient response'. Contrary to P's allegation, the reference in said statement to the patient response does not invalidate the requirement that in addition the administration protocol also depends on the dosage administered. In other words, already this statement establishes a functional link between the features of the dosage regimen i.e. the level of the doses administered and the timing of the doses, which thus according to decision T 1067/97 excludes the extraction of individual features, namely the level of the subsequent dose from their timing and relationship.

3.1 0.3.6

Example 3 teaches a specific embodiment of a rituximab treatment protocol for CLL. According to decision T 284/94 a claim may only be amended by the introduction of a technical feature taken in isolation from the description of a specific embodiment if it was clear beyond any doubt for a skilled reader from the application documents as filed that the subject-matter of the claim thus amended provided a complete solution to a technical problem unambiguously recognisable from the application. Example 3 teaches that the specific dosage regimen of rituximab achieves a therapeutic effect. Moreover, in view of the said statement at p. 6, and consistent with the expression "stepped-up dosing schedule" as interpreted by the OD, only the full dosage regimen provides a complete solution to the technical problem underlying the patent in suit of providing a therapy for CLL. This view is corroborated by the prior art documents on file which, if they relate to an application of multiple doses not only define their amount, but also their timing (cf. D2: abstract; D5: abstract; D12: p. 996, r-h c., para. 2; D16; p. 996, r-h c., para. ;2 D19: 1-h c., penultimate para. - r-h c., para. 2; D21: p. 3267, 1-h c., para. 4; D23-D27: abstracts; D28: p. 196, 1-h c., para. 3-6; D30: abstract; D49: abstract). The most generic dosage regimen disclosed in Example 3 is the application of a first dose of 375 mg/m2 followed by three subsequent weekly doses of between 500-1500 mg/m2, wherein all of said subsequent doses remain the same (cf. p.10, l. 21 - p. 11, l. 2).

3.10.3.7 P held that given that only 8 of the 16 patients enrolled in the study of Example 3 completed the treatment with 3 subsequent doses of 500-1500 mg/m2 of rituximab, Example 3 also taught treatment protocols comprising less than 3 subsequent doses down to a single subsequent dose, thereby establishing that the timing between the doses and their relative height was irrelevant i.e. that the level of the subsequent dose of 500-1500 mg/m2 can be extracted from Example 3. The OD disagrees with this line of argumentation for the following reasons. D3 states on p. 11, l. 11-12 that 'eight patients have completed therapy' i.e. that the other patients have not received the intended therapeutic protocol. No information is provided as to whether a therapeutic effect has been achieved also in the patients that have not completed the therapy. Hence, these patients have to be regarded as drop-outs in which the intended therapeutic effect has not been achieved. In other words, the complete solution of the underlying technical problem of providing a therapy for CLL is not achieved in these drop-out patients.

3.10.3.8 Furthermore, P referred to decision T 495/09 which he considered to support his case of allowing the extraction of individual features, namely the dose level of the subsequent doses from other features of the dosage regimen disclosed in Example 3. The OD, however, notes that said decision in point 5 of the reasons explicitly states that the allegedly omitted features were exclusively taught in relation to a monotherapy with rituximab, whilst the claim in dispute under Art. 123(2) EPC related to a combined treatment with rituximab and methotrexate which as such was also disclosed. In the present case, D3 does not contain a direct an unambiguous disclosure of the dosage regimen defined merely by a first dose of 350 mg/m2 and subsequent dosage of 500-1500 mg/m2. Thus, the facts underlying the case giving rise to decision T 495/09 are different from the present ones and said decision is therefore irrelevant to the present situation.

3.10.3.9 In summary, the OD concludes that the omission in the claims of the subsequent doses of 500-1500 mg/m2 being administered at constant levels three times at weekly intervals violates Art. 123(2) EPC.

3.11

Thus, the OD concludes that the main request does not meet the requirements of Art. 123(2) EPC.

5.13

The claims of AR4 cover at least three alternatives wherein 3 equal subsequent doses of 500-1500 mg/m2 rituximab are administered weekly, bi- weekly or monthly. Whilst the weekly dosage regimen finds an almost verbatim basis in Example 3, the other two alternatives require the extraction of the dose amounts, numbers and relative heights from Example 3which then have to be combined with the feature of a bi-weekly or monthly administration as disclosed at p. 6, l. 15-16. As discussed in detail under item 3.10.3 herein above, the separation of any of the features of the dosage regimen disclosed in Example 3 and defined by the amount of the doses, the timing and number of their administration and the relation between the doses violates Art. 123(2) EPC.

Tegen deze beslissing heeft Biogen beroep ingesteld bij de TBA2. In september 2016 heeft de TBA het beroep van Biogen afgewezen. De schriftelijke gronden van deze beslissing zijn thans nog niet beschikbaar.

2.5.

Op 8 maart 2017 heeft de OD in de oppositieprocedure met betrekking tot EP 313 een voorlopige (niet-bindende) opinie gegeven. Voor zover hier van belang luidt deze opinie als volgt:

2.9.1.2.7 In summary, it cannot be established beyond doubt that it would have been obvious to the skilled person that the dose unit of "mg/m3" in Example 3 is erroneous. Consequently, since already the first criterion for the implication of R. 139 is not met, the correction of mg/m3 in Example 3 is not allowable.

2.9.1.2.8 Since there is no other basis for defining a dosage of 500 - 1500 in terms of mg/m2 , the requirements of Art. 76(1) are not met either.

2.9.1.3 Dosage of 500 to 1500

2.9.1.3.1 D47 teaches a treatment of preferably B-PLL, CLL or transformed NHL

using an anti-CD20 antibody (p. 3, l. 4-7). More preferably the anti CD20 antibody is an antibody comprising human gamma 1 regions (p. 5, l. 9-10). The antibody is applied in a dose range of about 0.001 to about 30 mg/kg body weight (p. 6, l. 11-12). To arrive at the subject-matter of claims 1 and 9, respectively, CLL has to be selected from the foregoing list and the dose range has to be amended to 500 to 1500 mg/m2 requiring a change values and unit, wherein already the latter as discussed herein above infringes Art. 76(1) EPC.

2.9.1.3.2 The dose range disclosed at p. 6 is broad and covers 4 orders of magnitude. Compared thereto the claimed dose range is not only narrower, but also extends over the upper end of the dose range disclosed at p. 6 if converted to mg/m2 doses based on the conversion factor of D1. This limitation of the broader disclosure of the application is extracted from Example 3, wherein the said range is disclosed in the context of other features. Hence, claims 1 and 9 represent an intermediate generalisation between the aforesaid definition in general terms and the specific embodiment of Example 3. Therefore, P errs in arguing that the claimed dosage range is verbatim disclosed in Example 3 and thus as such combinable with other features disclosed in the D47.

2.9.1.3.3 Said intermediate generalisation is not allowable if the amendment presents the skilled person with new information which do not follow directly and unambiguously from D47 (cf. T 461/05). A restriction of a claim by adding a number of features from a particular embodiment originally disclosed does not in itself introduce such new information. By contrast, the omission of the remaining features of the embodiment will introduce new information if the omitted features were necessary to carry out the particular embodiment of the invention.

2.9.1.3.4 Example 3, as the opposed patent, aims at a therapy of CLL and teaches a therapeutic effect when applying a particular dosage regimen using a specific antibody, namely rituximab. The dosage regimen applied to all patients consisted in the administration of rituximab at a dose of 375 mg/m3 followed by three weekly administrations at increased dose levels (p. 10, l. 21 - p. 11, l. 2). The subsequent sentence at p. 11, l. 2 specifies that 'sixteen patients have been treated at dosages of 500-1500 mg/m3', thereby contextually specifying said increased dose levels. This link between the dosage regimen and the dosages of 500-1500 mg/m3 is confirmed by the following detailed description of individual patients treated according to said dosage regimen. Hence, it appears that, when said dosage of 500-1500 mg/m3 is extracted from said specific protocol using rituximab and combined with a generically defined anti-CD20 antibody comprising human gamma 1 constant regions without a definition of further administrations, additional information on how to achieve a therapeutic effect in CLL being the aim of the patent in suit is introduced beyond the disclosure of D47. This is i.a. confirmed by the statement at p. 6, l. 10-11 of D47 that 'effective dosages will depend on the specific anti-body'. Moreover, as argued by the Os, the dose of an antibody necessary to achieve therapeutic efficacy depends on its affinity and specificity which is not defined in claims 1 and 9. In addition, claims 1 and 9 are not limited to the specific dosage regimen taught in Example 3 to be therapeutically effective and D47 does not provide information how said therapeutic effect can be achieved outside of said regimen using a dose of the antibody of 500-1500 mg/m3. D47 teaches at p. 6, l. 15-16 that the administration of the antibody may be affected3 by various protocols, however emphasising that these protocols depend on the dosage administered to the patient, thereby further supporting the inextricable link between the dosage of 500-1500 mg/m3 and the administration protocol of Example 3. Consequently, based on foregoing considerations the requirements of Art. 76(1) EPC do not appear to be met.

2.9.1.3.5 The same conclusion has to be reached if the analysis is based on the

approach taken in T 284/94, implicated by O5, which considers a technical feature taken in isolation from the description of a specific embodiment as not allowable under Art. 123(2) EPC if it is not clear beyond doubt for a skilled reader from the application documents as filed that the subject-matter of the claim thus amended provides a complete solution to a technical problem unambiguously recognisable from the application. In the present case the technical problem is an effective therapy of CLL and the solution as derivable from Example 3 is the administration of rituximab in the described dosage regimen. There is no indication that a different dosage regimen will achieve the same therapeutic effect, let alone when using a different antibody, which, as discussed herein above may require a different dosage regimen.

2.6.

Celltrion en Celltrion Hungary behoren tot het Celltrion-concern, een wereldwijd opererend biofarmaceutische bedrijf. Celltrion houdt zich onder meer bezig met de ontwikkeling en distributie (via lokale distributeurs) van zogenaamde “biosimilars”. Celltrion heeft een biosimilar van rituximab ontwikkeld, thans genaamd Truxima.

Mundipharma is een Nederlands farmaceutisch bedrijf dat optreedt als distributeur van Celltrion in Nederland. Celltrion Hungary is de marktvergunninghouder met betrekking tot Truxima.

Op 13 mei 2016 heeft Celltrion bij deze rechtbank volgens het VRO-regime een nietigheidsprocedure aanhangig gemaakt tegen Biogen. In deze procedure (hierna: de VRO-procedure) vordert Celltrion vernietiging van (het Nederlandse deel van) EP 313 op grond van toegevoegde materie en gebrek aan inventiviteit en nieuwheid. Pleidooi in deze zaak is gepland op 19 mei 2017. In de dagvaarding heeft Celltrion aangekondigd dat zij voornemens is haar biosimilar van Rituximab in Nederland op de markt te brengen.

Nadat Celltrion in het Verenigd Koninkrijk (onder meer) met betrekking tot EP (UK) 313 een nietigheidsprocedure aanhangig had gemaakt tegen Biogen, heeft Biogen in juli 2016 ingestemd met de herroeping van het octrooi en een proceskostenvergoeding voldaan aan Celltrion.

2.9.

Naar aanleiding van de op 17 februari 2017 verleende marktvergunning voor Truxima door het European Medicines Agency (EMA) heeft Mundipharma op 22 februari 2017 een perspublicatie doen uitgaan met daarin de volgende mededeling:

Mundipharma to launch Truxima (rituximab), the first biosimilar monoclonal antibody for the treatment of cancer, in seven European markets

• Truxima® has been authorised for use by the European Commission (EC), making it the first biosimilar monoclonal antibody licensed for the treatment of cancer

• Truxima has been approved for use in all indications of the reference product Mabthera®, based on its preclinical, safety and efficacy data (…)

Mundipharma and its network of independent associated companies will launch Truxima (rituximab) in the UK, Germany, Italy, Netherlands, Belgium, Republic of Ireland and Luxembourg, following authorisation by the EMA. Truxima is

the first biosimilar monoclonal antibody authorised by the European Commission (EC) for the treatment of cancers, (…) including diffuse large B-cell lymphoma, follicular lymphoma and chronic lymphocytic leukaemia. (…)

2.10.

In maart 2017 heeft Biogen bij het Landgericht München tegen Mundipharma een kort geding aanhangig gemaakt en met betrekking tot EP (DE) 313 een inbreukverbod gevorderd. Nadat het Landgericht zijn voorlopige oordeel had gegeven over de sterkte van EP 313, heeft Biogen ter zitting van 19 april 2017 haar vordering ingetrokken.

2.11.

Bij brief van 5 april 2017 heeft Biogen c.s. Mundipharma gesommeerd om inbreuken op EP 313 te staken en gestaakt te houden.

2.12.

In de op 19 april 2017 gepubliceerde G-Standaard van mei 2017 is Truxima opgenomen, waarbij Mundipharma is opgenomen als producent, en Celltrion Hungary als registratiehouder.

3 Het geschil

3.1.

Biogen c.s. vordert, bij vonnis uitvoerbaar bij voorraad, Celltrion c.s. te verbieden om inbreuk te maken op, dan wel op enige wijze betrokken te zijn bij en/of te profiteren van inbreukmakende handelingen met betrekking tot het Nederlandse deel van EP 313, althans de conclusies 7 en 15 ervan, zulks op straffe van een dwangsom4 en met veroordeling van Celltrion c.s. in de proceskosten volgens 1019h Rv.5

3.2.

Aan deze vordering heeft Biogen c.s. het volgende ten grondslag gelegd.

Met de (dreigende) verhandeling van Truxima in Nederland maakt Celltrion c.s. inbreuk op de conclusies 7 en 15 van het Nederlandse deel van EP 313. Biogen en haar licentienemer Roche hebben een spoedeisend belang bij toewijzing van het gevorderde verbod, aangezien zij onomkeerbare schade lijden indien Truxima op de Nederlandse markt komt. Van Celltrion c.s. kan bovendien worden gevergd dat zij de door haar geïnitieerde bodemprocedure afwacht, waarvan het pleidooi al snel is.

3.3.

Celltrion c.s. voert gemotiveerd verweer. Zij stelt kort gezegd dat Roche niet ontvankelijk is want geen octrooihouder, en dat het octrooi nietig is omdat sprake is van toegevoegde materie en het niet nieuw noch inventief is.

3.4.

Op de stellingen van partijen wordt hierna, voor zover van belang, nader ingegaan.
